JUDICIAL DECISIONS
PREEMPTION BY FEDERAL LAW. --The Georgia Third Party Prescription Program Law of 1983, (see O.C.G.A. § 26-4-140 et seq.) affects employee benefit plans protected by the Employee Retirement Income Security Act of 1974 ("ERISA"), 29 U.S.C. §§ 1001, et seq., and is therefore preempted by the federal act. GMC v. Caldwell, 647 F. Supp. 585 (N.D. Ga. 1986).
